Terms and Conditions of Sale

Welcome to Cotenbi. These Terms form a binding agreement between you and Andrew James Cotey, doing business as COTENBI HOME, the operator of cotenbi.com, and apply to all visits and purchases. Our Return and Refund Policy, Shipping Policy and Privacy Policy are part of these Terms. Your use of the Site or completion of an order constitutes acceptance.

Who We Are

Cotenbi is the trading name of Andrew James Cotey (DBA COTENBI HOME), a limited liability company located at 2648 Beecham Ct, Fairfield, CA 94533, United States, EIN 42-3148081. We sell Halloween decorations online through this Site. You can reach us at help@cotenbi.com or the contact form, Monday to Friday, 9:00 AM – 6:00 PM (Pacific Time (PT)).

Age Requirement

Purchases may only be made by persons aged 18 or over who can lawfully enter into contracts. This Site is not intended for children under the age of 13, in line with the Children's Online Privacy Protection Act, and we do not knowingly collect their data. When you place an order you confirm that the information you provide is accurate and that you are authorized to use the chosen payment method.

Pricing

Prices are quoted in USD and can change without notice, but the price you see when you order is the price you pay. Applicable taxes (calculated at checkout based on the shipping address) and any shipping charge appear at checkout before payment, so the final total is always visible before you commit. Promotional "was" prices are genuine prior prices. Should an obvious pricing mistake occur, we are not obliged to sell at the wrong price: we will tell you and let you decide whether to proceed.

Refund and Cancellation Policy

Our cancellation and refund terms, in summary: cancel at no cost before the order ships; return eligible items within 90 days of delivery, unused and in original packaging, to 2648 Beecham Ct, Fairfield, CA 94533, United States; return postage is free; refunds go back to the original payment method 5–10 business days after we receive and inspect the item (7 business days for cancellations); faulty or wrong items are always replaced or refunded free of charge. The full Return and Refund Policy, which you accept at checkout, governs in case of any difference.

Payment Methods and Billing

We accept Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay and Shop Pay. Payments are processed securely by Shopify Payments (powered by Stripe); we do not store full card numbers on our servers. Your card is charged when the order is placed. The charge appears on your statement as COTENBI.COM. If a charge is declined, or our payment provider's fraud screening flags the order, we may ask you for additional verification or cancel the order. If you believe a charge is incorrect, please contact us before contacting your bank — most issues are resolved within a business day.

Delivery

Delivery is available to the United States. Processing takes 1–2 business days, then 9–15 business days with Standard Shipping (USD 7.95; free from USD 100) or 8–11 business days with Express Shipping (USD 19.95). Tracking is provided for every shipment. Should a shipment be delayed beyond the promised date, we tell you in advance and you may cancel free of charge for a full refund, as required by the FTC Mail, Internet, or Telephone Order Merchandise Rule. Our Shipping Policy contains the complete terms and forms part of this agreement.

How Orders Work

Your order is an offer to buy. After checkout you receive an order confirmation email; this acknowledges receipt of your order but does not accept it. A contract of sale is formed when we ship the goods and send the shipping confirmation. We may decline or cancel an order before shipment for reasons including unavailability, a pricing or description error, suspected fraud, or a shipping address we cannot serve; if we do, any payment is refunded in full within 7 business days. We may limit quantities per order or per customer.

Site Rules

Use the Site lawfully and in good faith: no fraudulent or unauthorized orders, no attempts to breach security, no automated scraping, no abuse of discounts. Reviews on our product pages come from customers who bought the product; we take reasonable steps to verify them and never commission fake reviews. Content you submit must be truthful and yours; you allow us to publish it and we may remove anything inappropriate.

Liability

To the fullest extent permitted by law, Cotenbi and its owner are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits or data, arising from your use of the Site or any product, and our total liability for any claim related to an order is limited to the amount you paid for that order. This limitation does not apply to liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection statutes. Some jurisdictions do not allow the exclusion of certain damages, so parts of this section may not apply to you.

Our Content

All content on the Site — text, product descriptions, photographs, graphics, logos and the Cotenbi name — is owned by or licensed to us and is protected by copyright and trademark law. You may view and print pages for personal, non-commercial use only. Reproducing, distributing or using our content for any other purpose without written permission is prohibited. If you believe content on the Site infringes your rights, email help@cotenbi.com with the details and we will respond promptly.

Product Information

Descriptions, specifications and photographs are provided in good faith and are as accurate as we can make them; small differences in color or finish can result from photography, lighting and display settings. Cotenbi sells generic, unbranded products; references to third-party brands, if any, describe compatibility and imply no endorsement. Listing an item does not guarantee stock. Where an item sells out after you order, you may wait, choose an alternative or receive a full refund.

Warranties and Disclaimer

We provide the limited warranty set out in our Return and Refund Policy. Except for that warranty, and to the fullest extent the law allows, we make no other express warranties, and implied warranties of merchantability and fitness for a particular purpose are limited to the duration of the limited warranty. Some states do not allow such limitations, so they may not apply to you; this warranty gives you specific legal rights and you may have others that vary by state. Consistent with the Magnuson-Moss Warranty Act, nothing in these Terms disclaims implied warranties while a written warranty is in effect.

Governing Law and Dispute Resolution

These Terms and any purchase are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law rules, and by the California Unfair Competition Law, Bus. & Prof. Code § 17200 et seq., and Consumers Legal Remedies Act, Civ. Code § 1750 et seq. where it applies. Please contact us first at help@cotenbi.com: almost every issue is resolved by our support team within a few days. Arbitration agreement. If a dispute cannot be resolved informally within 30 days, you and we agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its consumer rules, rather than in court, except that either party may bring an individual claim in small claims court. Class action waiver: claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase. This section is governed by the Federal Arbitration Act. Nothing in this section prevents you from filing a complaint with the consumer protection office of your state attorney general or with the Federal Trade Commission.

General Provisions

We may update these Terms from time to time; the version in force when you place an order applies to that order, and the current version is always available on the Site with its "last updated" date. If any provision is found unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Site and your purchases. You may not assign your rights under these Terms; we may assign ours to a successor of the business.
